  • A.   Premix Ltd is a Mauritian based company (“we”, “us”, “our” and “Premix”) focused on innovations and solutions with respect to inter alia construction materials (“Products & Services“) as more fully described on our website (“Site”).
  • B.   We take privacy and security of personal data very seriously and we are committed to ensuring that we safeguard the privacy and the personal data of inter alia those who use our Site and interact thereon for any purpose including but not limited to purposes related to our Products & Services. The said users are hereinafter referred to as “you” and/or “your” as applicable.
  • C.   Save and except for the matters set out herein, this Website User Privacy Policy should not be regarded, interpreted and/or construed as providing any additional terms and conditions nor any warranties whether expressly or impliedly. This Website User Privacy Policy describes our privacy practices and contains important and useful information for you. It explains:

means the Data Protection Act 2017 of the Republic of Mauritius, as amended from time to time and the General Data Protection Regulation of the European Union, as amended from time to time, and also includes the regulations and directives which may, from time to time, be made pursuant to the said legislations;

6. Your Rights

The Applicable Laws give you, the data subject, various rights in relation to your personal data that we hold and process. These rights are exercisable without charge, and we are subject to specific time limits in terms of how quickly we must respond to you. Those rights are as follows:

(a) Right to access: The right to obtain from us confirmation as to whether or not personal data concerning you is being processed, and, where that is the case, access to that personal data and various other information, including the purpose for the processing, with whom the data is shared, how long the data will be retained, and the existence of various other rights (see below).

(b) Right to rectification: The right to obtain from us, without undue delay, the setting right of inaccurate personal data concerning you.

(c) Right to erasure: Your right to request that, in certain circumstances, we delete data relating to you.

(d) Right to object: The right, in certain circumstances, to object to your personal data being processed by us.

(e) Right to withdraw consent: The right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

These rights are not absolute and should be reasonably exercised.

In response to a request, we will ask you to verify your identity if we need to, and to provide information that helps us to understand your request better. We will respond to your request within a reasonable time. If we do not comply with your request, whether in whole or in part, we will explain why.

7. Retention of data

We shall retain your data for as long as necessary to inter alia comply with our legal obligations and resolve disputes. We endeavor to delete this data as a priority if no longer necessary for use or held in compliance with the Applicable Laws.

8. Security and Safeguards

We use physical, electronic and administrative safeguards to assist us in preventing unauthorised access, maintaining data accuracy and correctly using personal data. Except as otherwise specified in this Policy, we use commercially reasonable efforts to limit access to your personal data to the employees/agents/officers who need this information to assist fulfil both our contractual and non- contractual obligations.

The personal data that we collect is securely stored within our database. We use standard, industry- wide practices such as firewalls and encryptions for protecting your information. Moreover, we regularly monitor our systems for possible vulnerabilities and attacks.

However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee a fool-proof security of our database, nor can we guarantee that information you supply won’t be intercepted while being transmitted to us over the internet. We therefore recommend that you do not disclose your password to anyone.

As a rule, we do not share any of your data with any third parties save and except as provided herein.

In certain circumstances, we may be legally required to share certain data held by us, which may include your personal data, for example, where we are involved in legal proceedings, where we are complying with legal obligations, a court order, or a governmental authority.

In order to optimize the quality of our Site and provide better services and information to our clients and potential clients, some of your data may be shared with our web hosting service provider and our website creator with whom we shall enter into enter into legally binding confidentiality and privacy agreements in order to fully protect your rights in compliance with the Applicable Laws.

We may compile statistics about the use of our Site including data on traffic, usage patterns, user numbers, sales, and other information. All such data will be anonymised and will not include any personally identifying data, or any anonymised data that can be combined with other data and used to identify you.

If we are acquired by or merged with another company, your information may be transferred to the new owners so that you may inter alia continue to benefit from the Products & Services.

14. Law & Jurisdiction

This Policy is governed by and interpreted according to the Laws of Mauritius. All disputes arising out of this Policy will be subject to the exclusive jurisdiction of the Courts of Mauritius.

15. Severability

If any court or competent authority finds that any provision of this Policy (or part of any provisions) is invalid, illegal or unenforceable, that provision or part thereof shall, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provision of this Policy shall not be affected.

16. Making a Complaint

If you have any issues or concerns as to the processing of any personal data relating to you, please contact our Data Protection Officer, whose details are provided under section 2 above.

Notwithstanding our best efforts, if you are unhappy with any aspect of the use and/or protection of your personal data, you have the right to make a complaint to the Data Protection Commissioner by firstly duly filling and signing the complaint form and the declaration form and secondly delivering same to “The Data Protection Commissioner, Data Protection Office, 5th Floor, SICOM Tower, Wall Street, Ebene, Mauritius”.
